By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. By placing an order, you confirm that you have the legal capacity to enter into this agreement.

  1. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy enumerated below.

  2. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

  3. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 

  4. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

  1. SECTION 6- ORDERING & PAYMENT

  1. All prices listed on our website are in Indian Rupees (INR) and are inclusive of applicable taxes.

  2. Payments can be made through Shopify Payments, Cashfree, UPI, credit/debit cards, net banking, and other secure third-party payment gateways integrated with our Website.

  3. Once an order is placed, you will receive a confirmation email. We reserve the right to cancel or refuse any order if fraudulent activity is suspected.

  1. SECTION 7-MODIFICATIONS TO THE SERVICE AND PRICES

  1. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

  2. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

  1. SECTION 8- SHIPPING & DELIVERY

  1. We partner with third-party delivery services to ensure safe and timely delivery of your products.

  2. Delivery times are estimated and may vary due to unforeseen circumstances. Any delay does not entitle customers to claim compensation.

  3. If your package is lost or damaged during transit, please contact us at hello@purpleforest.co within 48 hours of delivery.

  1. SECTION 9- RETURNS, REFUNDS & CANCELLATIONS

  1. Returns and refunds are only accepted for damaged, defective, or incorrect products at the time of delivery. Any product issues must be reported within the specified return period for resolution.

  2. Customers must raise a return request within 7 days of receiving the order by contacting hello@purpleforest.co . In the event that the request is not raised within 7 days of receipt of order, no request shall be entertained. 

  3. Refunds (if applicable) will be processed within 7-10 business days via the original payment method.

  4. Returns or Refunds cannot be claimed on used products. 

  5. Cancellations can only be made before the order is shipped, i.e within 48 hours of placing the order.  Once shipped, the order is non-refundable.

  1. SECTION 10 - THIRD PARTY TOOLS

  1. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

  2. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

  3. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

  4. We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

We have sole ownership of the Services Content as protected under Copyright laws applicable in all jurisdictions.

  1. In consideration of Purple Forest granting you the rights hereunder, you hereby agree not to use the Services for any purpose that is unlawful under any applicable laws and/or in violation of the Terms and our Privacy Policy. 

  2. We shall make all reasonable efforts to ensure that your information is kept confidential. However, we shall not be responsible for any disclosure or leakage of confidential information and/or loss or damage of your Device due to theft, negligence or failure on your part to practice safe computing.

  3. You understand and acknowledge that upon using the Services, you authorize us to access third party sites designated by you, on your behalf, to retrieve such information requested by you, and to register for accounts requested by you. 

  4. You acknowledge and agree that when we access and retrieve information from third party sites, we are acting as your agent, and not the agent or on behalf of the third party. You agree that such third parties shall be entitled to rely on the foregoing authorization, agency granted by you.

  5. You must notify your bank immediately in the event your credit/ debit card is lost, stolen, not received, swallowed at an ATM, or is being misused without your permission. Please refer the detailed instructions received from your bank for additional precautions to be taken in case of loss/ theft/ misuse of your credit/ debit card.

  6. You agree and acknowledge that we have no role or control over and assumes no responsibility whatsoever for, the User Content and by posting such User Content on the Website, you expressly undertake to be personally liable for any and all liability arising therefrom. 

  7. You also agree and acknowledge that we have a right to review the User Content but not an obligation to assess if the same is contrary to these T&C and/or any applicable laws. Further, we may remove any content from the Website and/or block, disable, terminate or suspend the User account in its sole discretion (including in the event a notice is received by us that such User Content is breaching any intellectual property right of any third party)

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions and offers. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel access if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have made your payment).

We shall not be liable for failing to perform, or delay in performance of, any of its obligations if, and to the extent that, such failure or delay is caused by an event substantially beyond its control, including but not limited to acts of God, acts of the public enemy or governmental authority in its sovereign or contractual capacity (including but not limited to declaration of lockdown), war, terrorism, floods, fire, strikes, epidemics, pandemics, civil unrest or riots, and/or power outage or grid failure.

We shall not be liable for  any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the access, use or performance of the services, functions and features or for interruptions, delay, etc., even if we were advised of the possibility of damages resulting from the cost of getting substitute facilities on the services, any services, data, information or services purchased or obtained or messages received or transactions entered into through or from the services, unauthorized access to or alteration of your transmissions or data statements or conduct of anyone on the services, or inability to use the services, the provision of or failure to provide the functions and features, whether based on contract, tort, negligence, strict liability or otherwise. This clause shall survive in perpetuity.

  2. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
